The FRY demands implementation of the Resolution 1244
New York, September 28 - The Federal Republic of Yugoslavia has reiterated its appeal and demand to the UN Security Council for the immediate and full implementation of the Resolution 1244 regarding the UN mission in Kosovo and Metohija.

The demand, accompanied by an all-round analysis and full facts on the situation in the southern Serbian province, summed up in a Yugoslav government Memorandum of June 10 on the violations of the Resolution 1244, has been distributed to all members of the Security Council.

The latest Yugoslav government Memorandum has been distributed at the UN as an official document at the request of the head of the Yugoslav Ambassador to the UN Vladislav Jovanovic.

The Memorandum points to the principal provision of the Resolution which must be taken as a starting point in any decision-making on Kosovo and Metohija - that sovereignty and territorial integrity of the FRY must be respected.

The document presents facts on the catastrophic situation in the province since the UN mission arrived on June 10, 1999, and underlines that Yugoslavia and Serbia have met all their obligations stemming from the Resolution 1244 and the Military-Technical Agreement.

A special section of the Memorandum presents firm evidence on the fiasco of the KFOR and UNMIK missions, and points to the fundamental reasons for their failure - the absence of security for all inhabitants of the province and particularly non-Albanians who are being subjected to terrorism, violence and ethnic cleansing.

KFOR and UNMIK have failed disastrously in each and every task, the Memorandum notes, quoting precise figures on continuing terror against non-Albanians - murders, abductions, seizure of property, arson, expulsions and other forms of violence that ethnic Albanian terrorists continue perpetrating before the very eyes of the UN mission.

The UN Secretary-General's special representative for Kosovo and Metohija Bernard Kouchner himself has largely contributed to the destabilization of the situation in the province by issuing over 70 decisions which have no foundations in the Resolution 1244, or even constitute a glaring violation of its provisions, the Memorandum says.

Such decisions of the civilian mission chief have largely contributed to the deterioration of the situation in the province and have encouraged ethnic cleansing and genocide against its non-Albanian population.

Any political settlement for Kosovo and Metohija must be based entirely on the respect of the sovereignty and integrity of Serbia and Yugoslavia, an inseparable part of which is Kosovo and Metohija, the document underlines.

A separate section of the memorandum on the conditions for a political settlement says that it must be based on a full and due implementation of UNMIK's and KFOR's mandate in line with Resolution 1244 and the Military-Technical Agreement.

This primarily means securing full personal and property safety for all in the province, disbanding and disarming the transformed terrorist self-styled KLA, respect of human rights, free and safe return of refugees and displaced persons, deportation of all foreigners who are staying in the province illegally, establishment of public order and security, freedom of movement, return of Yugoslav Army and police units and full control of state borders.

Any political settlement must be based solely on autonomy within Serbia and on guarantees of equality of all citizens and ethnic communities in Kosovo and Metohija, the Memorandum says and points out that dialogue among official and legitimate representatives of ethnic communities is the only way of achieving this goal.

Yugoslavia demands that the Security Council take immediate and decisive measures to realize the goals set out in Resolution 1244, including nullifying all decisions taken by the civilian mission chief which violate the Resolution 1244.

The Security Council should also strongly condemn and prevent any activities by the UNMIK chief and withdraw from the province all KFOR and UNMIK forces directly responsible for systematic violations of the Resolution, for the loss of many lives, for the untold suffering of Serbs and other non-Albanians and for damages caused by ethnic Albanian terrorists in the presence of tens of thousands of KFOR troops and UNMIK staff, the Memorandum says.
